Scopus Solar is planned for Bollinger County, Missouri. Under state law, the county is classified as a “third classification” county, meaning it has a valuation of less than $600,000,000 – its current valuation is $148,064,545. Chapters 64.510-64.727 apply to Bollinger planning and zoning authorities. Bollinger does not appear to exercise its zoning authority under the statute. Therefore, any new zoning regulations would need to originate with the county commissioners and then put to a popular vote for adoption.
Because zoning authority does not appear to have zoning codes or a planning commission in place, engagement will primarily be bilateral agreements with landowners, supplemented by interest group outreach (economic, agricultural, tourism, etc.) to manage community sentiment and reduce risks of opposition organization. Consider engaging the Southeast Missouri Regional Planning and Economic Development Commission to align their goals with the project and earn their support.

In this context, “decision-maker” is more theoretical if commissioners decide to exercise their authority during the project’s development. If a zoning ordinance is created, the developer would likely need to work with the county planning commission. Without that, the county commissioners are the originators of county zoning laws and infrastructure, so they would be the first point of engagement in this instance. Although it is unlikely the county commission will hold a vote on this project, engagement as a courtesy is advised.
